The Western Australian Legislative Council will consider the Assisted Reproductive Technology and Surrogacy Bill 2025 this week.
If passed, this bill will expand IVF and surrogacy access and weaken protections for women and children.
The government says this bill will “promote… acceptance of all ways of starting or expanding a family, including for those who require donor sperm, eggs and embryos to achieve this” and this is “regardless of sex, relationship status, gender identity, sex characteristics or orientation.”
Serious ethical, health, and human rights concerns have been raised — yet many Members of the Legislative Council may not be aware of the risks.

- Premature Lawmaking – The Australian Law Reform Commission review is due mid2026. Acting now risks inconsistency with national standards.
- Child Protection Gaps – The Bill lacks basic screening such as criminal record checks and WWCC.
- Lower Age Risks – Reducing the surrogate age to 18 increases exploitation risks.
- Coercion and Exploitation – Even “altruistic” surrogacy can involve pressure and commodification.
- Posthumous Conception Concerns – Use of gametes from deceased individuals raises ethical and identity issues.
