On Monday, 17 August, the Hon. Llew O’Brien introduced the Human Rights (Children Born Alive Protection) Bill 2026 into the House of Representatives.

The principle behind this Bill is simple:

Once a baby is born alive, that child deserves the same dignity, protection and appropriate medical care as every other Australian baby.

Yet this protection is not consistently guaranteed across Australia.

According to evidence presented to a Senate inquiry, 724 babies in Victoria and Queensland were recorded as born alive following attempted abortions over a ten-year period.

The situation is becoming increasingly urgent.

In Queensland alone, 75 terminations resulted in live births in 2023—more than three times the 22 live births recorded in 2013.

All of these babies are deserving of compassion and care.

The Human Rights (Children Born Alive Protection) Bill 2026 would establish a clear national principle of birth equality: that a child born alive following an attempted abortion must not receive a lesser standard of care simply because of the circumstances of his or her birth.

Appropriate care will depend on the baby's medical condition. In some cases, that may mean life-saving treatment. But the fact that a baby survived an attempted abortion must never, by itself, determine whether that child is treated as a patient deserving of care.

The Bill would also require the reporting of live births following abortions so Australia can finally have meaningful national data.

FamilyVoice believes this is a fundamental matter of human dignity, justice and equality before the law.

But the Bill will need courageous support from federal Members of Parliament.
